1. Acceptance of Terms

By accessing or using WinM (winm.ai), you agree to be bound by these Terms of Service. If you are using WinM on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

2. Description of Service

WinM is an AI-powered digital marketing platform that provides SEO insights, keyword research, content optimisation, rank tracking, competition analysis, content generation, and reporting services. Our platform integrates with Google Analytics, Google Search Console, and other third-party services to deliver actionable marketing intelligence.

3. Account Registration

  • Accounts are created by WinM administrators on your behalf
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must notify us immediately of any unauthorised access to your account
  • You are responsible for all activities that occur under your account
  • One account per client organisation; sub-users may be added as needed

4. Subscription and Tokens

  • WinM operates on a monthly subscription model with token-based usage
  • Each subscription plan includes a monthly token allocation
  • Tokens are consumed by AI-powered actions (analysis, content generation, insights)
  • Unused tokens do not carry over to the next billing period
  • Additional tokens may be purchased as top-ups
  • Trial accounts receive a limited token allocation as specified during sign-up

5. Payment Terms

  • Subscription fees are billed monthly in advance
  • All prices are quoted in Indian Rupees (INR) unless otherwise stated
  • Payments are processed through secure third-party payment providers
  • Late payments may result in account suspension
  • We reserve the right to modify pricing with 30 days’ written notice

6. Acceptable Use

You agree not to:

  • Use WinM for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or disassemble the platform
  • Share your account credentials with unauthorised parties
  • Use automated tools or scripts to access the platform beyond normal usage
  • Upload or transmit malicious code, viruses, or harmful content
  • Use AI-generated content in ways that violate applicable laws or third-party rights
  • Resell or redistribute WinM services without written authorisation

7. Intellectual Property

  • The WinM platform, including its design, code, and branding, is our intellectual property
  • Content generated by AI through WinM for your use belongs to you
  • Your business data, brand assets, and uploaded content remain your property
  • You grant us a limited licence to use your data solely to provide our services

8. Third-Party Integrations

WinM integrates with third-party services including Google Analytics, Google Search Console, Google Tag Manager, and DataForSEO. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or accuracy of third-party services.

9. AI-Generated Content

  • AI-generated content (blogs, landing pages, insights) is provided as a starting point and should be reviewed before publication
  • We do not guarantee the accuracy, completeness, or originality of AI-generated content
  • You are responsible for reviewing and editing AI-generated content before use
  • AI insights and recommendations are advisory in nature and should not be the sole basis for business decisions

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our control, including third-party service outages, internet connectivity issues, or force majeure events.

11. Limitation of Liability

To the maximum extent permitted by law, WinM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

12. Termination

  • Either party may terminate the subscription with 30 days’ written notice
  • We may suspend or terminate your account immediately for violation of these terms
  • Upon termination, your access to the platform will be revoked
  • We will retain your data for 90 days post-termination for data export requests

13. Governing Law

These terms shall be governed by the laws of India. Any disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi, India.

14. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of WinM after changes constitutes acceptance.
